General sales conditions

The brand 10 DOIGTS (trade name) is marketed by mail order and on the Internet by the company NBC 10 DOIGTS SAS. The following provisions establish the General Sales Conditions of the products offered on this site by the company 10 DOIGTS.

Company identity

Placing an order implies acceptance of the General Sales Conditions. Any order with online payment will only be considered after acceptance of payment by the GIE bank cards. The parties agree that the contract is governed by French law, the language of the GSC being French. 10 DOIGTS informs the consumer of all the essential characteristics of the goods offered (colours, quantities, volumes, descriptions, prices). These characteristics appear alongside the photograph illustrating the offer. The photos illustrating the products do not fall within the contractual scope. The consumer acknowledges that the photograph representing the product shown on the website is only indicative and not contractual; alterations may indeed appear due to photo processing. These General Sales Conditions can be modified at any time by 10 DOIGTS. Specific conditions for certain products or services may complement these General Conditions.

Our customer service will record your order by phone, as well as your payment by credit card (mandatory for orders made by phone).

The prices quoted are valid until the release of the next catalogue, except for significant fluctuation in raw materials or VAT. They are valid only for metropolitan France, Belgium, Germany, Luxembourg, Spain, Canada, the Netherlands, Italy, Austria and Portugal; please consult us for other countries. For the DOM-TOM, the prices charged by our distributors may differ in order to include approach costs. Prices are calculated all taxes included (VAT included at the rate of 20%) excluding participation in shipping costs. For books, the applicable VAT is 5.5 %.

Delivery

Metropolitan France, Corsica, DOM-TOM, Spain, Portugal, Austria, Belgium, Germany, Luxembourg, Italy, the Netherlands, Canada, the United States, Finland.

Delay

Orders are shipped within 24 to 48 hours (excluding weekends and public holidays). The transport time is then 24 to 48 hours from the dispatch of the package. Depending on the time of year, these delays may vary significantly; during the order validation process you will find a precise indication of the processing time. These delays take into account product availability as well as the workload in the warehouse; they are given for information only and are not contractual.

Standard delivery

Note: payment upon order (credit card, cheque or transfer) is mandatory for delivery to a relay point.

For home deliveries, to a personal address. Payment upon order is mandatory for delivery by Colissimo.

For schools, associations, town halls, nursing homes, companies… In short, an address where someone can receive the package during normal business hours.

Express delivery (next-day delivery if the order is placed before 12 p.m.)

Note: payment upon order is mandatory for Chronopost delivery to a relay point.

Receipt of goods

At the time of delivery, we suggest you check the contents of the package(s) in the presence of the delivery person. On the receipt, indicate your name in full, date, sign and affix your stamp. In case of damage or missing items, you must note on the receipt the nature and extent of the damage for each item, in the presence of the delivery person, then immediately send us a copy of this signed receipt. Be very vigilant about the general mention « subject to unboxing »: it has no legal value and therefore does not authorize any recourse against the carrier. Any significant anomaly, such as a torn package resulting in product deterioration, must be reported by registered letter to the carrier within 3 working days of receipt of the package; please send us a copy of this letter.

Withdrawal period

Under the Consumer Code, the customer has a withdrawal period of 14 days from the delivery of the ordered products to change their mind. Returned products must be in their original packaging, in perfect condition, accompanied by all accessories and instructions, if any. Return shipping costs are the responsibility of the customer, who must send the item in a tracked package to: 10 DOIGTS — 19 rue du Trieu de Quesnoy — 59115 LEERS — France. Upon receipt and after checking the good condition of the products, 10 DOIGTS will refund by cheque the amounts received for the returned goods, excluding participation in shipping costs and any delivery options.

Personal data

The data collected by 10 DOIGTS on its site is intended for it. The customer may give their consent or oppose the use of the data collected for this order, as part of the customer file of 10 DOIGTS, as well as their use by third parties. In accordance with law n° 78-17 of 6 January 1978, known as the Data Protection and Freedom Law, the customer has a right of access, rectification and deletion regarding any information concerning them. Dispute resolution

For any complaint related to an order, the customer can contact 10 DOIGTS by e-mail at contact@10doigts.com. An amicable solution will be sought before any other action.

Entirety

In the event that any clause of this contract is deemed null and void due to a change in legislation, regulation, or a court decision, this shall in no case affect the validity and observance of these General Sales Conditions.

Applicable law and jurisdiction

The parties agree that the contract is governed by French law and that only French courts can hear these disputes, the language of the General Sales Conditions being French. Any potential disputes between 10 DOIGTS and any individuals, communities or companies fall under the jurisdiction of the commercial court of Roubaix, notwithstanding the plurality of defendants and/or calls for guarantee, even for emergency or precautionary procedures in referral or by request. It is also agreed that, in case of a potential dispute, the parties will do everything possible to find an amicable solution.

Intellectual property

All elements of the site www.10doigts.com are protected by copyright and trademark law. They are the exclusive property of 10 DOIGTS or its partners and cannot therefore be copied, reproduced or downloaded in whole or in part without the express and prior authorization of 10 DOIGTS, except for elements whose rights are held by the suppliers of the products presented on the site. Any total or partial reproduction of 10 DOIGTS catalogues is strictly prohibited and constitutes infringement that may lead to civil and criminal liability for its author.
