The brand 10 DOIGTS (trade name) is marketed by mail order and on the Internet by the company NBC 10 DOIGTS SAS. The following provisions establish the General Sales Conditions of the products offered on this site by the company 10 DOIGTS.

Placing an order implies acceptance of the General Sales Conditions. Any order with online payment will only be considered after acceptance of payment by the GIE bank cards. The parties agree that the contract is governed by French law, the language of the GSV being French. 10 DOIGTS informs the consumer of all the essential characteristics of the goods offered (colors, quantities, volumes, descriptions, prices). These characteristics appear alongside the photograph illustrating the offer. The photos illustrating the products do not fall within the contractual scope. The consumer acknowledges that the photograph representing the product shown on the website is only indicative and not contractual. Alterations may indeed appear due to photo processing. These General Sales Conditions can be modified at any time by 10 DOIGTS. Specific conditions for certain products or services may complement these General Conditions.

The prices quoted are valid until the release of the next catalog; except for significant fluctuation in raw materials or VAT. The prices are valid only for metropolitan France, Belgium, Germany, Luxembourg, Spain, Canada, the Netherlands, Italy, Austria, Portugal. Please consult us for other countries. For DOM TOM, the prices charged by our distributors may differ in order to include the approach costs. Prices are calculated all taxes included (VAT included at the rate of 20%) excluding participation in shipping costs. For books, the applicable VAT is 5.5 %.

Delay:

Orders are shipped within 24 to 48 hours (excluding weekends and public holidays)
The transport time is then 24 to 48 hours, starting from the dispatch of the package.
Depending on different periods of the year, these delays may vary significantly. You will find, during the order validation process, a precise indication of the processing time of your order. These delays take into account the availability of products, as well as the workload in the warehouse. These delays are given for information only, they are not contractual.

For home deliveries, to a personal address.

• delivery to a professional address by carrier: Flat rate of 7.90€ (4.90€ for orders > 59.90€)

For schools, associations, town halls, nursing homes, companies... In short, an address where there is always someone to receive the package during normal business hours.

Express Delivery (Delivery the next day if the order is placed before 12 p.m.)

• delivery via Chronopost to a relay point : Flat rate of 7.90€ (4.90€ for orders > 49.90€)

Note: Payment upon order (by credit card, check, or transfer) is mandatory for Chronopost delivery to a relay point

• delivery via Chronopost at home: Flat rate of 10.90€ (7.90€ for orders > 59.90€)

For home deliveries, to a personal address.

Receipt of goods:

At the time of delivery, we suggest you check the contents of the package(s) in the presence of the delivery person. On the delivery person's receipt, indicate your name in full, date, sign, and affix your stamp.
In case of damage or missing items, you must note on the receipt the nature and extent of the damage for each item, in the presence of the delivery person.
Immediately send us a copy of this signed receipt.
Be very vigilant about the general mention "subject to unboxing". It has no legal value and therefore does not authorize any recourse against the carrier.
All significant anomalies, such as a torn package resulting in product deterioration, must be reported by registered letter to the carrier within 3 working days of receipt of the package.
Please send us a copy of this letter.                           

Withdrawal period

Under the Consumer Code, the customer has a withdrawal period of 14 days, starting from the delivery of the ordered products, to change their mind.
Returned products must be in their original packaging, in perfect condition, accompanied by all accessories and instructions, if any. Upon receipt and after checking the good condition of the products received in return, 10 DOIGTS will proceed to refund by check the amounts received for the returned goods, excluding participation in shipping costs and any delivery options.

The data collected by 10 DOIGTS on its site is intended for it. The customer may give their consent or oppose the use of the data collected for this order, as part of the customer file of 10 DOIGTS as well as their use by third parties.

Dispute resolution

For any complaint related to an order, the customer can contact 10 DOIGTS by email at contact@10doigts.com. An amicable solution will be sought before any other action.

Entirety

In the event that any of the clauses of this contract is deemed null and void due to a change in legislation, regulation, or a court decision, this shall in no case affect the validity and observance of these General Sales Conditions.

Applicable law and jurisdiction

The parties agree that the contract is governed by French law and that only French courts can hear these disputes, with the language of the General Sales Conditions being French. Any potential disputes between 10 DOIGTS and any individuals, communities, or companies fall under the jurisdiction of the commercial court of Roubaix, notwithstanding the plurality of defendants and/or calls for guarantee, even for emergency procedures or precautionary procedures in referral or by request.
It is also agreed that in case of a potential dispute, the parties will do everything possible to find an amicable solution.

Intellectual property

All elements of the site www.10doigts.fr are protected by copyright and trademark law. They are the exclusive property of 10 DOIGTS or its partners and cannot therefore be copied, reproduced, or downloaded in whole or in part without the express and prior authorization of 10 DOIGTS, except for elements whose rights are held by the suppliers of the products presented on the site. Any total or partial reproduction of 10 DOIGTS catalogs is strictly prohibited and constitutes infringement that may lead to civil and criminal liability for its author.
